Pre-Suit Family or Civil Mediation
Most lawsuits are settled rather than actually tried in a court of law. Historically, of the cases that settle, many are resolved on the “courthouse steps,” years after the lawsuit was filed and after having spent a lot of money during the litigation process.
Pre-suit mediation is an informal process where the parties meet with an impartial mediator in an attempt to address the disputes and reach a mutual agreement resolving the disputes, prior to filing a lawsuit.
Pre-suit mediation occurs before costly litigation has ever been commenced and is handled outside the judicial system. Some of the advantages are:
- Pre-suit mediation is cheap. Litigation is not cheap.
- Pre-suit mediation can be scheduled and completed quickly.
- You get a preview of the other party’s position and a rehearsal for your own position.
- Pre-suit mediation is confidential. Litigation is in the public records.
